Welcome to the Pinkgratitude Platform (as defined below) brought to you by Pinkgratitude, Inc., a Delaware corporation (“Pinkgratitude,” “we,” “us,” or “our”). By accessing, using, or registering for an account on our website, mobile application, or any of our related products, features, content, tools, or other offerings (collectively, the “Services”), including any beta or pre-release versions (together, the “Platform” or the “Pinkgratitude Platform”), you confirm that you have read, understood, and agree to be bound by our Child Safety Policy, these Terms of Service, our Privacy Policy, and our Community Guidelines. If you do not agree to these terms, you must not use the Platform.

Acceptance of Terms
By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by our Child Safety Policy, these Terms of Service, our Privacy Policy, and our Community Guidelines, which together form the full agreement between you and Pinkgratitude.
If you do not agree to these terms, do not use the Platform.
Eligibility
You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement and are legally capable of entering into this agreement.
User Registration
Access to the Platform requires registration and the creation of a user account. You agree to maintain the confidentiality of your login credentials and accept full responsibility for all activities that occur under your account. We reserve the right, at our sole discretion, to remove, reclaim, or alter any username that we deem, in our judgment, to be inappropriate, misleading, or otherwise in violation of our Child Safety Policy, these Terms, our Privacy Policy, or our Community Guidelines.
License to Use
Pinkgratitude, Inc. grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Pinkgratitude Platform and its Services solely for your personal, non-commercial purposes, in accordance with these Terms and applicable laws.
This license is granted for use with your individual account only and automatically terminates when your account is deleted, suspended, or otherwise terminated, or when you stop using the Platform.
You may not copy, modify, distribute, sell, lease, reverse-engineer, decompile, or otherwise exploit any part of the Platform or its Services without our express written consent.
User Content
“User Content” refers to any posts, comments, messages, images, videos, or other material submitted, uploaded, or shared by users on the Platform.
You retain ownership of the User Content you post on the Platform. However, by posting such content, you grant Pinkgratitude a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, distribute, display, and otherwise utilize the content without restriction and without compensation to you.
You are solely responsible for the User Content you post. By using the Platform, you agree not to submit any content that is illegal, harmful, defamatory, infringing, or otherwise violates the rights of others, as set out in our Child Safety Policy and our Community Guidelines.
Please note that any public posts you make may be viewed, reported, shared, or referenced by other users or third parties both within and outside the Platform. Once shared publicly, your content may no longer be under your control. Therefore, we urge you to carefully consider your privacy before disclosing personal or sensitive information.
By using the Platform, you acknowledge and accept that Pinkgratitude, its shareholders, officers, directors, employees, representatives, and third-party service providers are not liable for any consequences resulting from the reporting, sharing, or redistribution of your User Content by other users or external parties.
All other content on the Platform—including but not limited to text, graphics, logos, software, and design elements—is the exclusive property of Pinkgratitude or its licensors, excluding your User Content. You may not reproduce, distribute, or otherwise use content from the Platform outside the scope of the features provided (such as sharing or reposting) without obtaining appropriate authorization from the content owner or rights holder.
Our trademarks, service marks, and logos are protected by applicable intellectual property laws and are the sole property of Pinkgratitude. Any other trademarks featured on the Platform are the property of their respective owners.
If you submit feedback, suggestions, or ideas regarding the Platform:
- Your submission is entirely voluntary and creates no obligation on our part;
- You grant us full ownership of the feedback;
- We may use or share your feedback without restriction or compensation;
- We retain ownership of all correspondence you send to us.
Prohibited Use
By using the Platform, you agree not to engage in any conduct that violates our Child Safety Policy, and our Community Guidelines or in any of the following activities, all of which are strictly prohibited:
- Illegal, Dangerous, or Harmful Conduct: Do not engage in or promote illegal, violent, exploitative, or self-harming activities, including any form of child sexual abuse material or non-consensual intimate imagery.
- Security and Platform Abuse: Do not compromise accounts, spread malware, or misuse the platform for scams or surveillance.
- Harassment, Hate, Abuse, and Sexual Content: Do not harass, impersonate, or promote hate speech, sexually explicit or pornographic material, or graphic sexual violence.
- Defamation, False Claims, and Reputation Harm: Do not spread false or damaging claims about others or engage in public shaming.
- Deception, Misinformation, and IP Violations: Do not share misleading content or violate intellectual property rights.
- Privacy Violations and Personal Data Abuse: Do not misuse, collect, or publish someone else's private or sensitive data without consent.

API and Platform Access
Access to the Pinkgratitude application programming interface ("API") or any other programmatic interface of the Platform is strictly prohibited without obtaining prior, express written consent from Pinkgratitude. Any authorized use of the API must be conducted in accordance with these Terms and any additional terms or documentation specifically governing API usage, as may be provided by Pinkgratitude. Pinkgratitude reserves the right to suspend, limit, revoke, or permanently terminate API access, in whole or in part, at its sole discretion and without prior notice, for any reason or no reason
Commercial Use
The use of the Platform, including its Services, API, data, or any related features, for commercial purposes is strictly prohibited unless expressly authorized in writing by Pinkgratitude. Prohibited commercial activities include, but are not limited to: charging fees for access to any aspect of the Platform, monetizing access to or data from the Platform, developing or distributing derivative services or applications, and offering premium or paid functionalities derived from Platform content or capabilities. Any such unauthorized use constitutes a material breach of these Terms and may result in immediate suspension or termination of access, in addition to any legal remedies available to Pinkgratitude
Brand Protection
The Pinkgratitude name, logo, trademarks, and other brand identifiers ("Brand Assets") are proprietary intellectual property owned exclusively by Pinkgratitude and are protected by intellectual property laws. You shall not use, reproduce, display, or distribute any Brand Assets without prior written consent from Pinkgratitude. Any unauthorized use of Brand Assets that implies affiliation, endorsement, sponsorship, or partnership with Pinkgratitude is strictly prohibited. Furthermore, you may not create, use, or distribute any materials or services that could cause confusion with, dilute, or tarnish the goodwill associated with Pinkgratitude's Brand Assets, including the development of derivative logos or similar branding elements.
Third-party Links and Sharing
The Platform may include features that allow you to capture and share a screenshot of your user profile via integrated third-party services, such as Instagram or WhatsApp. Use of these third-party integrations is subject to the terms and privacy policies of the respective services. Pinkgratitude disclaims any responsibility or liability for the practices, content, or data handling of these external platforms.
In-App Purchases
Pinkgratitude does not currently offer or support any form of in-app purchases or premium paid features. Pinkgratitude reserves the right to introduce such features in the future at its sole discretion. Any changes or additions to in-app purchase capabilities will be communicated to users through official channels within the Platform.
Reporting and Content Removal
We may review and act on reported content in accordance with our Child Safety Policy, these Terms, our Privacy Policy, and our Community Guidelines. This may include storing and analyzing content as part of the moderation process. We reserve the right to remove content or suspend accounts that violate our Child Safety Policy, these Terms, our Privacy Policy, or our Community Guidelines. If you believe someone has violated your rights in any way, contact us at moderation@pinkgratitude.com.
Beta and Pre-Release Versions Testing
If you access or otherwise use any beta, pre-release, or test version of the Pinkgratitude application (whether through a beta testing program such as Apple TestFlight or by any other means), you acknowledge and agree to the following:
- The beta version is pre-release software provided for testing and feedback purposes only.
- It may contain bugs, incomplete features, or performance issues.
- Pinkgratitude Inc. may modify, suspend, or terminate beta access at any time without notice.
- You agree not to share screenshots, videos, or unreleased features publicly without our written permission.
- We may collect anonymous diagnostic and performance data (such as crash logs, feature usage, performance metrics) to improve the product;
- No in-app purchases, paid content, or monetization features are available during beta testing.
Participation is voluntary and does not create an employment, agency, or partnership relationship with Pinkgratitude, Inc.
Termination
We may suspend or terminate your account at any time for violating our Child Safety Policy, these Terms, our Privacy Policy, or our Community Guidelines, or during beta testing as part of our evaluation process. You may also stop using the Platform at any time. Upon termination, your right to use the Platform will immediately cease, and we reserve the right to delete all your User Content and data associated with your account.
Disclaimers
The Platform is provided “as is.” We don’t guarantee it will be error-free or always available. We are not responsible for content posted by users or third parties. You agree to indemnify and hold harmless Pinkgratitude, its shareholders, officers, directors, employees, representatives, and third-party service providers from any and all costs, damages, liabilities, or legal claims arising out of or related to:
- Your use of the Platform
- Your violation of our Child Safety Policy, these Terms, our Privacy Policy, or our Community Guidelines, or any applicable laws
- Your violation of others' rights
- User Content you submit to the Platform
- Your use of automated tools (bots, crawlers, etc.) that burden our systems
Governing Law
These Terms are governed by the laws of California, and any disputes must be resolved in the courts of that jurisdiction.
Limitation of Liability
To the fullest extent permitted by law, Pinkgratitude, Inc., its shareholders, officers, directors, employees, representatives, and third-party service providers shall not be liable for any damages, losses, actions, suits or claims including third-party claims arising from your use of, or inability to use, the Platform.
Compliance with Laws
You agree to comply with these Terms and all applicable laws and regulations.
Disputes Resolution
If you have any concern or dispute about the Platform and its Services, you agree to first try to resolve the dispute informally by contacting us at dev@pinkgratitude.com.
United States Legal Compliance
- You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country.
- You are not listed on any United States government list of prohibited or restricted parties.
Severability and Waiver
Severability: If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
Waiver: Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
Translation Interpretation
These Terms Of Service may have been translated if we have made them available to You on our Platform. You agree that the original English text shall prevail in the case of a dispute.
Changes to These Terms
We may update these Terms from time to time. If we make significant changes, we’ll notify you via the Platform or by email. Continued use means you accept the new terms.

No Guarantee of Data Retention
We do not guarantee that any User Content you post to the Platform will be stored or remain accessible except if legally required. While we take reasonable steps to protect and maintain the Services, you are responsible for backing up any important information or content you post. We may modify, archive, or delete content at any time, including in the event of technical issues, account closure, or business failure. Pinkgratitude is not liable for any loss of data or content
User Confirmation
By using Pinkgratitude, you confirm that you have read, understood, and accepted these Terms of Service, as well as our Child Safety Policy, our Privacy Policy, and our Community Guidelines. Your continued use of the Platform constitutes ongoing acceptance of these terms and any future updates.
